The Alberta Fault Determination Rules (commonly known as the Fault Rules or FDR ) is a regulation under the Alberta Insurance Act to determine driver responsibility after a car accident in Alberta. Drivers can be 0%, 25%, 50%, 75%, or 100% at fault.
These rules apply to car accidents in Alberta. Car accidents outside of Alberta are judged using the legislation of the province, territory, or state where it occurred.
Determination of Degree of Fault [ edit ]
The fault rules have some basic conditions which state that insurers have to use these rules when determining fault, They also specify that conditions like weather and visibility cannot be taken into consideration, and that the location of damage on the vehicle is not evidence of fault.

The insurer shall determine the degree of fault in accordance with this Regulation.

Fault is determined without considering the circumstances in which the accident occurs, including weather conditions, visibility or the actions of pedestrians.

The location of damage on any vehicle or it's load is not evidence of fault.

When Multiple Fault Rules Apply [ edit ]
Section 3 is to be used when more than one fault rule applies:

In an accident with 2 vehicles, if one rule would make an insured at fault, while another would make them not at fault, the insured is 50% at fault for the accident.

In the rare case that no fault rule applies, then section 4 is to be used:
